CakeTop Studio (the “Studio”) at cookiehigh.com is run by Jack Kitterhing, trading as CookieHigh, a sole trader based in London, United Kingdom (“we”, “us”, “our”). You can contact us at hello@cookiehigh.com.
2. These terms
These terms apply when you create an account, use the Studio (including the 3D editor, My Designs, the Pricing Sheet, the Size Chart, the Help Center and help requests) or buy a subscription. By creating an account or subscribing you agree to them. Please also read our Privacy Policy, which explains how we use your personal information.
If you are using the Studio as a consumer, nothing in these terms affects your legal rights under UK consumer law. If you use it for your business (for example, making toppers to sell), some parts apply differently and we say so where that is the case.
3. Your account
You must be 18 or over to create an account.
Give us accurate details and keep your email address up to date — it is how we reach you about your account and billing.
Keep your password private. You are responsible for what happens under your account. Tell us straight away at hello@cookiehigh.com if you think someone else has used it.
Accounts are for one person. Please don’t share your login.
4. Studio Access subscription
What you get. Studio Access unlocks the 3D cake topper editor with designs saved to your account, the Cake Topper Pricing Sheet, the Size Chart and STL export.
Plans and price. Studio Access is available as a monthly plan at £20 per month or a yearly plan at £200 per year, including any VAT or sales tax that applies. Both plans include the same features.
Billing and renewal. You pay for the first month or year when you subscribe. Your plan then renews automatically on the same date every month (monthly plan) or every year (yearly plan) at the price shown when you subscribed, until you cancel. Your next renewal date is always shown on your Billing page.
Who processes your payment. Payments are handled by Stripe, which acts as the merchant of record (reseller) for your subscription: it takes your payment, calculates and collects any VAT or sales tax, and issues your receipts. Stripe’s own checkout terms also apply to the payment. We never see or store your full card details.
Failed payments. If a renewal payment fails, Stripe will retry it and we will let you know. If it still can’t be taken, your access will end, but your saved designs stay in your account for when you resubscribe.
Price changes. We may change the price. We will email you at least 30 days before a new price applies to you, and you can cancel before then if you don’t want to continue.
Promotions and granted access. Discount codes and access we grant for free (for example, as part of the course) apply only on the terms stated when they were given.
5. Cancelling and refunds
Cancel any time. Go to My account → Billing → Manage billing. Your access continues until the end of the month or year you have already paid for and you won’t be charged again. To stop a yearly plan renewing, cancel before its renewal date.
No partial refunds. We don’t refund part of a month or year, or unused time, when you cancel, except where the law requires it or we have made a mistake (for example, charging you twice).
Your 14-day cancellation right. UK law normally gives consumers 14 days to cancel a contract for digital content. Studio Access starts immediately after you pay. When you subscribe (by clicking “Continue to secure checkout” or “Subscribe”) you ask for access to start straight away and acknowledge that, because of this, you lose the 14-day right to cancel for that payment. You can still cancel future renewals at any time as described above.
If something goes wrong. If the Studio is faulty or not as described, you have rights under the Consumer Rights Act 2015, including a repair or replacement and, in some cases, a price reduction or refund. Contact us and we will put it right.
6. The Topper Method course
The Topper Method course is sold and delivered through Teachable, on Teachable’s checkout and under its terms. A course purchase includes 12 months of Studio Access, which we add to the CookieHigh account with the same email address (or when you sign up with it). If the course purchase is refunded, the included Studio Access time is removed.
7. Your designs and uploads
You own your designs. Designs, text, SVG artwork and fonts you create or upload (“your content”) stay yours. You give us permission to store, process and display your content only so that we can run the Studio for you — for example, saving designs to your account, generating previews and producing STL files.
You need the rights to what you upload. Only upload artwork, logos, characters and fonts you own or are licensed to use, including for commercial use if you sell what you make. Many fonts and characters are protected — using them without a licence is your responsibility, not ours.
Keep your own copies. We back up our systems, but we recommend exporting STL files of anything important.
Help requests. When you send a help request with a screenshot, we use it only to answer your question.
8. Acceptable use
Please don’t:
upload anything unlawful, hateful, obscene or that infringes someone else’s rights;
try to break, overload, probe or get around the security of the Studio, or access other people’s accounts or data;
copy, resell, scrape or reverse-engineer the Studio, its editor, templates, Pricing Sheet, Size Chart or Help Center, or share paid tools with people who haven’t subscribed;
use automated tools to access the Studio other than through a normal web browser.
9. Our content
The Studio, its software, design, gallery shapes, templates, guides, Pricing Sheet and Size Chart belong to us or our licensors. While your account is active you may use them to create and sell your own cake toppers and other printed pieces. You may not copy or redistribute the tools or guides themselves.
10. Printing and food safety
The Studio helps you design files; it doesn’t make or inspect the physical item. You are responsible for choosing suitable materials and printers, checking every file before printing, and making sure anything that touches food is made and used safely — for example, using food-contact-safe filament where appropriate and keeping picks out of the edible parts of a cake. Sizes and settings in the Size Chart, Pricing Sheet and Help Center are guidance only; check them against your own cakes, printer and prices.
11. Availability and changes
We work to keep the Studio available and your designs safe, but it may sometimes be unavailable for maintenance or reasons outside our control. We may update or improve the Studio over time. If we make a change that significantly reduces what you pay for, we will tell you in advance and you can cancel; if you have paid for time you can no longer use as a result, we will refund it.
12. Our liability to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited by law, including your rights as a consumer.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that wasn’t foreseeable. If digital content we supply damages your device or other digital content because we didn’t use reasonable care and skill, we will repair the damage or compensate you.
If you use the Studio for business, we are not liable for loss of profits, sales, business, revenue or data, or for any indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.
We are not responsible for how printed items are made, sold or used, or for the outcome of your prints.
13. Suspending or closing accounts
We may suspend or close an account that seriously or repeatedly breaks these terms, after warning you where it is reasonable to do so. If we close your account for reasons that are not your fault, we will refund any time you have paid for but can’t use. You can ask us to close your account and delete your data at any time by emailing hello@cookiehigh.com; please cancel your subscription first.
14. General
Changes to these terms. We may update these terms, for example when the law or the Studio changes. For significant changes we will tell you by email or in your account before they take effect. The date at the top shows the latest version.
Transfer. We may transfer this agreement to someone who takes over the Studio; your rights will not be reduced as a result.
If part of these terms is invalid, the rest still applies.
Law and courts. These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland you can also bring them in your local courts.
